Terms and Conditions

Last updated: June 16, 2026

These Terms and Conditions govern the use of Ninaku, a management system for food and beverage businesses, made up of the Ninaku Go (mobile), Ninaku POS (web) and Ninaku Menu apps. By creating an account or using the service you accept these terms. If you do not agree, do not use Ninaku.

Acceptance of the terms

By registering or using Ninaku you confirm that you have read and accept these Terms and Conditions, as well as our Privacy Policy. If you use the service on behalf of a business, you declare that you have the authority to bind that business to these terms.

Service description

Ninaku offers tools to manage and operate food and beverage businesses: order taking, kitchen, cash register, inventory, digital menu, reports, e-invoicing and payments, through the Ninaku Go, Ninaku POS and Ninaku Menu apps. We may add, change or remove features to improve the service.

Accounts and responsibilities

To use Ninaku you need an account. You are responsible for:

  • Providing truthful information and keeping it up to date.
  • Keeping your credentials and those of your team confidential.
  • All activity carried out from your business's accounts.
  • Correctly setting up staff permissions according to their role.

Acceptable use

You agree to use Ninaku in a lawful and responsible manner. It is not permitted to:

  • Use the service for unlawful or fraudulent purposes.
  • Attempt to breach security, access third-party data or interfere with the service.
  • Copy, resell or redistribute the software without authorization.
  • Upload content that infringes third-party rights or applicable law.

Subscription and payments

Ninaku is offered through a subscription plan. The applicable prices, billing cycles and add-ons are disclosed at the time of purchase. Failure to pay may suspend or limit access to the service. Applicable taxes are calculated according to current legislation.

Your business's invoicing to its end customers, as well as tax compliance before the SRI, is the responsibility of the business owner.

Intellectual property

The software, the Ninaku brand, the design and all elements of the service are the property of its owner and are protected by applicable laws. The data and content you upload (menus, products, images) remain yours; you grant us a limited license to process them for the sole purpose of providing you with the service.

Availability and support

We work to keep the service continuously available, but there may be interruptions due to maintenance, technical failures or causes beyond our control. We offer support through support@ninaku.io during business hours.

Limitation of liability

Ninaku is provided "as is". To the extent permitted by law, we are not liable for indirect damages, lost profits, data loss or interruptions arising from the use or inability to use the service. It is your responsibility to operate your business and to comply with your legal and tax obligations.

Termination

You may stop using Ninaku and request the cancellation of your account at any time. We may suspend or terminate access if you breach these terms or if the law requires it. After termination, certain data may be retained as described in our Privacy Policy and due to legal obligations.

Governing law and jurisdiction

These terms are governed by the laws of the Republic of Ecuador. Any dispute will be submitted to the competent courts and tribunals of Ecuador, without prejudice to the rights granted to the consumer by law.

Changes to the terms

We may update these terms when necessary. We will publish the current version on this page with its update date. Continued use of the service after a change implies acceptance of the new terms.
